Express Scripts Hit With RICO Lawsuit: The Swiss Shell Game That May Have Robbed Patients for Years

Bernstein Litowitz Berger & Grossmann, one of the most feared class action firms in the country, just filed against Express Scripts and Cigna on behalf of the Plumbers' Welfare Fund and potentially thousands of employers and unions nationwide.

The allegation is staggering. Express Scripts allegedly created a shell company in Switzerland called Ascent to hide rebate money that was contractually supposed to go back to employers, unions, and patients. Drug companies paid "fees" to Ascent instead of rebates to clients. Same money. Different label. Pocketed instead of passed through.

And here is the part that should make your blood boil.

Cigna's own chief medical officer at the time, Steve Miller, allegedly admitted this scheme let them "double, triple dip on fees" without their customers ever knowing.

That is not a plaintiff's accusation. That is an internal confession.

Evernorth, the division that houses Express Scripts, accounts for roughly 60 percent of Cigna's total profits. More than their actual insurance business. This is not a side hustle. This is the engine.

RICO allows treble damages. Three times actual losses. Given the scale and the years this allegedly ran, the liability could be existential.

Every employer. Every union. Every patient who paid for prescriptions through Express Scripts deserves to know: were you being robbed through a Swiss mailbox while being told your PBM was saving you money?
